FCC Seeks Comment on FirstNet Band 14 Incumbent Relocation Requests

The FCC’s Public Safety and Homeland Security Bureau (PSHSB) released a notice seeking comment on an ex parte proposal made by the First Responder Network Authority (FirstNet) to facilitate the relocation of incumbent public-safety communications systems operating in the 758 – 769 and 788 – 799 MHz band 14 spectrum.

FirstNet told the FCC its board recently approved a spectrum relocation grant program designed to facilitate relocation of band 14 incumbents and that it expects funding for the grant program to be released early next year. FirstNet asked that band 14 incumbents not be allowed to operate in the spectrum without express consent of FirstNet after July 31, 2017. FirstNet further requested that the commission condition continued operation on band 14 on the cessation of all operations on the spectrum within 90 days written notice to the incumbents from FirstNet that deployment of the national public safety broadband network (NPSBN) has begun.

In its 2013 notice of proposed rulemaking (NPRM) in the proceeding, the commission sought comment on the appropriate mechanism to transition incumbent narrowband operators out of band 14 as well as the timeframe for the transition. Specifically, the commission asked for comments on whether FirstNet should manage or provide funds for the transition process, and whether the commission should establish a hard deadline by which relocation should be completed.

The commission said it has received comments on the NPRM but elected to expedite comment on FirstNet’s specific requests. Comments are due 14 days after publication in the Federal Register.
