Motorola Solutions Files Patent Infringement Complaint Against Hytera with ITC
Wednesday, March 29, 2017 | Comments

Motorola Solutions filed a patent infringement complaint with the U.S. International Trade Commission (ITC) against Hytera Communications. The ITC complaint asserts that Hytera is unlawfully importing and selling two-way radio equipment and systems and related software and components that infringe Motorola Solutions’ patents.

This ITC complaint follows patent infringement and trade secret misappropriation complaints filed by Motorola Solutions against Hytera March 14 in the U.S. District Court for the Northern District of Illinois. Hytera responded to the complaints following the court filing.

Motorola Solutions seeks an immediate investigation by the ITC, an exclusion order to halt the importation of the infringing products, and a cease-and-desist order to stop the marketing and sale of the infringing devices in the United States.

“On behalf of our customers, shareholders, employees, partners and other stakeholders, Motorola Solutions will continue to aggressively defend our proprietary technology and investments in innovation,” said Mark Hacker, general counsel and chief administrative officer of Motorola Solutions. “Motorola Solutions is the world’s leading provider of two-way radio equipment and systems, and we have invested billions of dollars over the last several years to achieve this position. In 2016 alone, we invested more than $500 million in research and development.”

Hacker said Motorola looks forward to a full and fair hearing before the ITC, as well as the federal district courts in Chicago.

"Motorola Solutions’ new action continues its pattern of legal maneuvering instead of competing with Hytera in the marketplace," said Hytera in a statement. "The case at the International Trade Commission covers the same subject matter and addresses the same patents as the cases filed in mid-March. Hytera will defend itself against these allegations, and we are fully confident that we will prevail.

"Hytera is built on innovation. We are the fastest-growing radio communications company in the world. We will remain proactive in protecting our innovative technologies, and we respect the intellectual property rights of others.

"Hytera embraces competition, which results in increased innovation and more choices for dealers and customers. We will continue to stand by our principles and compete vigorously to bring cutting-edge products and solutions to the market."
