Australian Judge Lays Out Initial Timeline for Motorola-Hytera Case

Federal Court of Australia Justice Nye Perram set a deadline of 9 October for Hytera Communications to respond to Motorola Solutions’ claims of patent infringement. Following Hytera’s response to Motorola’s initial complaint, Motorola will have until 18 October to reply to that complaint.

At the end of July, Motorola filed suit against Hytera in the federal court, alleging infringement of three Australian patents Motorola holds.

An initial case management hearing occurred 5 September, and Perram scheduled a second case management hearing for 8 November.

Perram’s order also set a schedule for initial discovery in the case. The two companies will begin exchanging proposed categories for discovery in October with agreement on those categories expected at the start of November. Then in mid-December, the parties are to provide initial discovery to the court.

The order does not provide a date or potential timeline for a trial in the case.

The Australian lawsuit is one of six that Motorola filed against Hytera this year. The company filed theft of trade secrets and patent infringement cases with the U.S. District Court for the Northern District of Illinois and a patent infringement case with the U.S. International Trade Commission (ITC).

Motorola also filed patent infringement suits against Hytera in the German regional courts of Dusseldorf and Mannheim.

Hytera filed a patent infringement lawsuit of its own against Motorola in the U.S. District Court for the Northern District of Ohio in August, alleging that Motorola had incorporated sound adjustment technology patented by Hytera in its MOTOTRBO portables.
