LMCC Joins UTC in Urging Rulemaking on Part 22 Changes

The Land Mobile Communications Council (LMCC) filed an ex parte letter with the FCC supporting the request made by the Utilities Technology Council (UTC), a member of the LMCC, regarding Part 22 rules.

The UTC asked the FCC to issue a notice of proposed rulemaking (NPRM) in the 2014 proceeding regarding technical and operational flexibility in the rules governing the Part 22, Subpart E, paging and radiotelephone service.

In 2014 comments, LMCC suggested 13 modifications to the Part 22 FCC rules in an FCC filing. LMCC reminded the FCC of comments filed previously in this proceeding in which it noted inconsistencies between the rules governing the Part 22 spectrum and those applicable to VHF and UHF Part 90 spectrum operated by private LMR entities. These inconsistent regulations inhibit optimal use of Part 22 spectrum.

The LMCC argued that adopting an NPRM that both supports greater flexibility and removes regulatory inconsistencies would support commission efforts to promote flexible allocations and more intensive use of spectrum.
