FCC Freezes Part 90 Applications at 5.9 GHz

The FCC announced a temporary freeze on the acceptance and processing of new and expanded use applications related to Part 90 services operating at 5.85 – 5.895 and 5.905 – 5.925 GHz and on processing applications to renew Part 90 licenses in the 5. 9 GHz band.

FCC Dec. 17 issued a notice of proposed rulemaking (NPRM) that sought comment on proposals to amend Parts 15 and 90 of its rules to repurpose the 5.9 GHz band to support high-throughput broadband applications and re-designate the 5.905 – 5.925 GHz portion of the band for cellular vehicle to everything (C-V2X) operations.

The commission also sought comment on whether to authorize C-V2X operations at 5.895 – 5905 GHz or continue to reserve that spectrum for dedicated short range communications (DSRC) operations.

The purpose of this freeze is to stabilize the 5.9 GHz spectrum landscape by suspending the acceptance and processing of applications in these portions of the band while the FCC considers future use of the band and continues to solicit comments from interested parties.

The suspension of filing and processing applies to applications pertaining to new or expanded DSRC service roadside unit location registrations in the intelligent transportation service (ITS) that operate in the 5.9 GHz band. The FCC will not accept or process applications to modify ITS geographic licenses by adding or changing DSRC roadside unit locations that operate in the band and applications to modify existing licenses by changing technical parameters that expand a station’s spectral or geographic footprint, including increases in bandwidth, power, antenna height or changes in frequency, in the 5.9 GHz spectrum. The FCC also will not accept any other application that would substantially alter the licensing landscape in the band.

The freeze does not apply to applications that would not substantially alter the current licensing landscape in the spectrum. The full public notice is here.
