Florida DOC’s Request for Reconsideration of License Termination Denied

The FCC denied a petition from the Florida Department of Corrections (DOC) seeking reconsideration of a license termination.

In November 2019, the FCC’s Universal Licensing System (ULS) sent a construction reminder to the Florida DOC alerting it of a pending construction deadline for callsign WRCY224 and establishing February 25 as the deadline for it to file a notification of construction.

The Florida DOC did not file a construction notification or request an extension of the construction period. In April, ULS issued a notice that the license had been terminated because the deadline passed. That same month, Florida DOC filed a petition asking for reconsideration of the termination.

In the petition, the Florida DOC said that it had not completed construction of the new station because of the COVID-19 pandemic and that it had not filed an extension request due to an administrative oversight.

The FCC determined that the Florida DOC had not provided sufficient justification to overturn the termination.

“While we recognize that the COVID-19 pandemic has dramatically altered construction schedules, it would not have prevented DOC from filing a timely extension request,” the FCC said. “Administrative oversight is not a unique factual circumstance justifying a waiver and excusing failure to comply with the commission’s construction notification requirements.”

If the Florida DOC seeks to continue operating the station, it will need to file a new, properly coordinated application. If the department needs to operate while the application is pending, it can file a request for special temporary authority.
