FirstNet Amends PSAC Charter to Exclude Participants from States Diverting 9-1-1 Fees

The First Responder Network Authority (FirstNet) board passed a resolution updating the board’s bylaws and its Public Safety Advisory Committee (PSAC) charter during its May 5 meeting. The PSAC charter update adds text preventing representatives from any taxing jurisdiction or state that is currently diverting 9-1-1 fees from participating in the PSAC.

The change to the charter is intended to address requirements set forth in the Don’t Break Up the T-Band Act, which was passed as part of the Consolidated Appropriations Act at the end of December, said FirstNet Board President Robert “Tip” Osterthaler. That law was aimed at repealing the T-band auction mandate and preventing states from diverting 9-1-1 fees to uses other than 9-1-1. 9-1-1 fee diversion is an issue the FCC has been working to prevent for many years now.

The other change to the PSAC’s charter included in the resolution was an administrative change that reflects a realignment FirstNet underwent in 2020 to create a new marketing arm, Osterthaler said. The changes to the charter detail how the PSAC and that arm of the FirstNet Authority work.

The FirstNet board also approved changes to its own bylaws. The changes are the first comprehensive updates to the board’s bylaws since it first began in 2012, Osterthaler said. The changes are intended to clarify the role of board members in FirstNet now that the authority has transitioned to a slightly different role with AT&T deploying the network, he said.

The resolution also includes administrative changes to the bylaws to help streamline certain processes within the authority.
