FCC Denies License Requests from Nevada State Parks, Pennsylvania Town

The FCC denied requests from two jurisdictions to reinstate terminated licenses.

The FCC denied a petition and waiver request from the Nevada State Parks Division requesting reconsideration of termination of its license to operate under call sign WQYH709. Nevada State Parks also requested a waiver to complete construction of the facilities authorized by its license.

The FCC said claims of administrative inadvertence are inadequate to excuse either a failure to construct or to timely submit a construction notice. Nevada State Parks has not shown that the underlying purpose of the rules would not be served or would be frustrated by application to the instant case nor has it shown that that its negligence in meeting the deadlines was due to unique or unusual factual circumstances.

The FCC also denied a petition from the township of Warminster, Pennsylvania, requesting reconsideration of the FCC’s notice of termination of call sign WQYL539.

Warminster also requested an extension of time of unspecified duration to construct the facilities authorized by its now-expired license. The commission said Warminster failed to demonstrate that its claimed site acquisition delays that pushed back installation of the antenna and associated equipment were because of causes beyond its control. The town also proposed an indefinite extension of time to complete construction.

“We previously have not granted such indefinite extensions and, because Warminster has failed to demonstrate timely construction or that grant of its petition would be in the public interest, we deny its petition without prejudice,” the commission said.

The FCC said both entities may file a new, properly coordinated application to use its previously licensed frequencies. In addition, if they need to operate while their applications are pending, the jurisdictions may file requests for special temporary authority (STA).
