FCC Seeks Nominations for 9-1-1 Fee Diversion Task Force

The FCC is seeking nominations for the Ending 9-1-1 Fee Diversion Now Strike Force. Nominations are due March 12.

As part of the Consolidated Appropriations Act, 2021, Congress required the FCC to take several actions to help prevent states from diverting 9-1-1 fees to other uses. On February 17, the FCC released a notice of proposed rulemaking (NPRM) that would establish allowed uses for 9-1-1 fees and requested comment.

The appropriations act also required the FCC to establish a task force focused on several topics related to 9-1-1 fee diversion, including:
• Determining the effectiveness of federal laws, regulations, policies, practices and financial or budgetary constraints that can most expeditiously end 9-1-1 fee diversion;
• Consider whether criminal penalties could help prevent fee diversion; and
• Determining the impact of 9-1-1 fee diversion.

The task force is required to release a report on any recommendations on how to most quickly end 9-1-1 fee diversion and the progress made by federal agencies so far on implementing the recommendations by September 23.

Under the legislation, the task force membership should include any federal agency the FCC deems necessary, as well as state attorneys general, state or taxing jurisdictions not taking part in 9-1-1 fee diversion, state or taxing jurisdictions trying to end 9-1-1 fee diversion, state 9-1-1 administrators, public-safety organizations, groups representing the public and consumers, and groups representing public-safety answering point (PSAP) professionals.

Members will be selected to fairly balance the expertise and viewpoints that are necessary to effectively address the issues to be considered by the task force. Members of the task force, including the chairperson, will be selected by the FCC chairperson in consultation with appropriate commission staff.

The commission intends to establish the task force by April and hold the first meeting in May. Nominations for membership to the task force should be submitted to the FCC no later than March 19.
