Reconsideration of 4.9 GHz Framework, 6 GHz AFCs on FCC’s September Agenda

The FCC will consider an order on reconsideration that would vacate the 4.9 GHz leasing framework it adopted in 2020 at its September board meeting.

Last year, the FCC passed an order that created a framework under which states could lease spectrum in the band to non-public-safety entities. Previously, the band was reserved for public-safety use, but the FCC had been looking for ways to revitalize it, arguing that it was underused.

Many public-safety organizations came out against that decision and the FCC eventually stayed the implementation of the new leasing framework.

In addition to the order on reconsideration, the FCC will also consider a notice of proposed rulemaking (NPRM) that would seek comment on a nationwide framework for the 4.9 GHz band, ways to foster greater public-safety use of the band and ways to facilitate non-public-safety access to the band.

Additionally, the FCC will consider a public notice that will begin the process for authorizing automated frequency coordination (AFC) systems for the 6 GHz band.

Also, in 2020, the FCC adopted rules allowing unlicensed use of the 6 GHz band. That decision also received backlash from public-safety, as well as critical infrastructure, entities, who argued that the decision could harm critical microwave links in the band.

Other topics of discussion for the September meeting include spectrum requirements for the internet of things (IoT), shielding 9-1-1 call centers from robocalls and promoting more resilient networks.
