The FCC cited Jose Perez for programming unauthorized frequencies into a transmitter in violation of the FCC’s Part 90 rules. The commission directed Perez to cease and desist from programming transmitters to operate on frequencies for which they are not authorized and to avoid any recurrence of this misconduct. If Perez fails to comply with these rules, he may be liable for significant penalties, including fines of up to $20,134 per day.

The FCC reminded all emergency alert system (EAS) participants and the public that the Federal Emergency Management Agency (FEMA), in coordination with the FCC, will conduct a nationwide test of the EAS Aug. 7, with a backup date of Aug. 21. All EAS participants must file form two in the EAS Test Reporting System (ETRS) by Aug. 7 and ETRS form three by Sept. 23.
